Paypals uk registered address for court procedings please??

Hi all

Some of you may have read my other threat titled help with paypal claim please.
Short version.

Buyer brought item
Courier damaged item in transit to buyer
I agreed send back for a refund
Buyer sends back
Buyer opens paypal claim

Right the item is valued at £212 including delivery
I have never receievd or signed for the item
It is not showing as delivered at my address, my address is nowhere on the tracking page

There terms and condiions state

For transactions that total less than 150 GBP (or the amount in the currencies set out below), proof of delivery is confirmation that can be viewed online and includes: the delivery address, delivery date, and the URL of the postal company’s website if you selected “Other” in the drop-down menu. For transactions that total 150 GBP (or the amount set out in the currencies set out below) or more, you must get signature or another acceptable confirmation from the addressee (usually the buyer) of delivery. The amounts in other currencies applicable to this requirement are

Latest call to paypal supervisor he says
"well the item was delivered 3.2 miles from your home and has a print on there thats all we will ned.

I say
"well the tracking dose not show as delivered to my address as steted in your terms and conditions and there is no signature just a print that is not in my surname and i have an email from the courier the buyer used to say the item was left in the porch and needs to be claimed for as lost by the sender (my buyer) i offer to forward the email from the operations manager at the courier dep and his name and number

They are not interested so i ask for paypals uk registered address to issue court proccedings and he says the claim has not been dealt with yet, i say well by what you have already said despite the facts you will side with my buyer.

He said i will email you our complaints procedure address, and if you are not happy you can contact the fos, i said yes please send me those details but i know you have a uk registered address so that is whrere i will isue court proccedings.

End of converstation then i receieve an email with you guessed it luxemburgs paypal address

So if anyone has the uk registered address please could i get it as it look as though i will need to sue for my money back

I have a few addresses but do not know if they are right

or eBay, Complaints Department, Hotham House, 1 Heron Square, Richmond upon Thames, Surrey, TW9 1EJ)

or Ebay (UK) Limited, 5 New Street Square, London, EC4A 3TW OR Whittaker House, Whittaker Avenue, Richmond, Surrey, TW9 1EH (registered address for Paypal (Europe) Ltd and Paypal (UK) Limited

    The richmond one is the UK registerd address as far as I know. If you start or threaten court proceedings with them even if you get your money back (which i'm not sure you will). They will close your PP account and you will be unable to use paypal (and therefore ebay) ever again.

    I would be persistent with them before I went down the court proceedings route and also look at the courier. I also think you would lose as I think they are actually correct re guarding the ruling within there T&Cs (it may not be morally correct though). I think you are quoting the wrong Terms and conditions to them

    I think (though I could be wrong that this only applies to sales, not to returns. Which could be why they have ruled in the buyers favour. It's only as a seller that you need to send to the PP address. As you as a seller can specify any return address you want. So as far as they are concerned the item is returned

    If I was you I would be pressuring the courier as I think you are in a no win with PP.

    There is nothing there quoting the same conditions as you need to comply with for normal seller protection. This is why I think technically PP are correct. As the tracking shows the item was delivered which according to this is all they need. (It doesn't state to what address.

    If I was you I would pressure the courier I don't think you'll have much luck with PP

    You do know you can take PayPal to the Financial Ombudsman Service (for free), don't you?

    I would say the problem lays with the buyer sending the item back incorrectly, or the courier/postal service.

    What address was it delivered too, who gave them this address, did the buyer put the right address on it etc.

    Hi there

    Thanks for all your replies so far, it looks like i was quoting the wrong terms, but what i can not get my head around is

    As a seller i have to prove delivery of an item
    But before the dispute was open i already told the buyer to return the item for a refund.
    Buyer then realised item had gone missing and opened a paypal claim.

    Now i have proof from the courier she used saying he had spoken to dhl and they say the item was left in the porch wich is similar to the printed name on the tracking just an extra p and c added. and that the item was missing and needed to be claimed for.

    So if as a seller i have to deliver safely to the buyer how come the buyer dose not have to proove safe return in order to obtain a refund and what is then stopping her making a claim agains the courier for the missing item as she was the sender and holds the paperwork,
    Why and how do i have to chase the courier , i am very confussed and appreciate all comments.

    Thank you very much for that,

    I have contacted the FO today so will wait to hear back from them
    Off to my local DHL tommorow to see what they have to say about the matter and as i can prove the item was never delivered see if they will ammend the tracking info to show this so then i can phone paypal and get them to look at it again as it's seeming the only option so far.

    Can i just ask have you issued court procedings of just involved th FO

    I'm sure an Irish address is of no use for a moneyclaimonline claim.

    An Irish address is absolutely fine. Thanks to the wonders of the European Union, individuals can claim upto €2000 via a small claims procedure.

    Do a google search and all will be revealed.

    Thanks to all who replied.

    As most of you said and i knew paypal found in her favour at 4:30 this morning and have refunded.

    I have been down the local dhl office shown them everything and explained the situiation and have been told the courier will come round today.

    I asked what then happens and was told we would take it from there.

    GRRRRRRRRRRRRRRRRR so angry now.
    No item and £212 down
