Valid cancellation terms?

I'm trying to cancel a gym membership and have been informed that although I've given one months notice, as advised when I joined, the terms and conditions I agreed to state '... such notice begins from the end of the month in which the written notice is given'.

Here begins the dispute! I don't believe they can require one months written notice whilst also making their own determination as to when that written notice begins. Surely one months notice is one months notice, from whenever it is given. They could of course require more than one months notice, if they said that, but that isn't what they're saying.

The amount of money involved isn't huge, and it's not all about the money, it's also about their underhand way of scheming another months membership out of people who took a monthly plan purely so they could cancel whenever they want to.

I'd be very interested to hear what others feel about this.

Full text:

"You may terminate your monthly Membership on giving 1 month's notice of termination in writing to the xxxxx facility at which your joined as a member such notice to begin from the end of the month in which the written notice is given."

Additionally, this is further enforced by the next item reading:

"Your monthly Membership will be renewed automatically by us on a monthly basis. If you do not intend to renew your Membership you must give us at least 1 month's prior written notice of this. Upon termination you will be responsible for cancellation of your Direct Debit arrangements. If there is still a balance of money due to us you must pay is immediately."

.. no mention of when the notice begins here - just that one months notice must be given.

Seems standard and if thats what you agreed to thats what you agreed to and are bound by it.....

It doesnt seem fair but gym contract rarely are fair.

The bit you have quoted here says...

at least 1 month's prior written notice...

Which tends to reinforce your first quote, doesn't it?

If it said 30 days then i would take it to start from when i informed them i was cancelling.

However if it said at least one month, i would question it but probably assume it would start and the end of the current month.......in order to fufull the contract and give them one completes month notice.
