Bank charges -offered refund, then bank enters a defence?

Hi,
My mum is trying to recalim her bank charges. She went through all the different stages and received a letter offering half.
Se refused and didn't hear anything for about a week then got a letter asking if she was going to reply. She replied again saying she had already replied but the next day (Before her 2nd letter could have been read) she got a letter offering the full amount.

Great! So she sent bank the form accepting this. Today a week later she gets a letter from the court saying her bank has offered a defence and she has to go to court. As you can guess she is very upset!

Anyone got any experience of this or any advice please?

    From what I remember, the bank enter a defence automatically. Accept the full repayment offer that the solicitors have offered you - they will eventually ask you to contact the courts to explain that the case has been settled out of court.

  • Thanks for that. I think what is worrying her is that the solicitors received her acceptance on 4th by recorded delivery and the court letter says the defence was entered on the 6th so it looks like they havd changed their mind.

    worst case would be to take the letter and your acceptance along to the court - the judge would not be impressed I think

    assuming you accepted within any deadlines they set

  • I'd still contact the court to say its been settled out of court. Which bank was it?

    The defence may have been entered on the 6th but the court could have received it days before then.
  • I think she will be contacting the court to let them know. I promised her I wouldn't mention the name of the bank (confidentiality clause or something?)
