Pont, Your response is useful. Thanks for the comments and I will take them on board when I next call AEG or contact Pixmania.

As for the last response about wanting something for nothing. Its hardly what I am after, when i purchase something which is the top product within its range then i expect it to last. There is a law is in place to support on this matter and i am just looking for friendly and useful advice.

I could have bought a cheap £200 fridge freezer but my purchase was made in line with the quality of the product and the reputation of the manufacturer. I accept that faults do happen but it is not reasonable for me to have to spend £400 every 3 years on a new fridge freezer.

    unholyangel,

the offer from AEG is not for £400, it is just a reduction on that model, which isn' as good as the one i have currently. I was told that i could select a different model and they would offer me another reduced price accordingly.

If i was offered £400 then i would bite their arm off.

One of my may problems is that now I am expected to take up AEG's offer but to be honest my opinion of AEG products is some what less than it was and I do not know if I want another AEG Fridge freezer.

I was offered £400 cash then I would buy a £400 product and the problem would be over.

I am being sold an AEG product at wholesale price basically. They won't lose anything or gain anything.

What they're offering you atm seems to be a goodwill gesture. You could ask them to make another offer but you may not get another one as good but they might be able to offer another fridge/freezer if you explain the sizes in compartments are important to you.

Based on a life expectancy of 6 years, you'd be looking at £350 as a partial exchange/refund - so in that light, their offer is good as they're offering £380 technically.

However i understand you may not have faith in their products anymore. Have you tried looking for online reviews of the new model offered to see what others say?

OP, one thing to bear in mind that nobody has picked up on yet is that Pixmania are a French company (or at least it was) so the SOGA wouldn't apply, although there would likely be a French equivalent but this would be much harder to follow through on. Take the offer, it is very reasonable.

Sounds like someone else after something for nothing. You already have a good offer take it. If you push it you'll end up with nothing.
Whoa! Totally wrong - I am somebody who wants an expensive item to work properly for a reasonable length of time. Nothing more, nothing less.

As you've had the item for 3 yearish. The limitation time wise with soga is 6 years its also states that a deduction can be made from you refund for the proportion of the time you've had use of the item

say judge accepts that the item should last more than 6 years atm you'll be entitled to £350. A judge though may decide that your fridge should only last say 4 years so then you'd only be entiled to £175

To get anywhere in court you'll have prove that the fault is inherent with the item and not though fair ware and tear which will require a independent engineers report done at your expense that backs up your claim. You can claim the money back if i find in your favour.

If it's any help I've just had a similar dispute last month with Samsung (TV). It broke down after I'd had it for 2 1/2 years (18 months out of warranty). I googled my make and model and found there were others with the same problem. Samsung sent out an engineer who confirmed the fault wasn't down to me. I then contacted Samsung again and was offered a 'goodwill gesture' of £230 - I declined and told them I'd be happy to see them in court. Next day I had a call from Samsung to inform me a brand new (better spec) TV was on its way. Samsung have since delivered my new TV and took away the faulty one.

    1) Google your make and model number - if there are others out there with a similar problem it helps and gives you ammo.
    2) An expensive item is supposed to last, I think, 6 years. If it doesn't, under normal useage, I believe the argument is that there was a fault at the time of manufature.
    3) Don't accept their first offer!

I'm suprised that Samsung didn't laught at you. You had no contract with them, only with the retailer you bought it from.

Fair play to them for replacing it for you.

I think Samsung 'played ball' because there were pages of complaints on various websites, all with the same problem. This is the reason I suggested that the OP googled their particular make and model to see if they're experiencing a common fault.

In my case it seems like there was an inherent fault with the TVs (something to do with faulty capacitors). When I first contacted Samsung I thought they would refer me back to the retailer as per my contract, but they didn't. Full marks to Samsung for accepting responsibility (they certainly didn't laugh at me) and putting the matter right.

You should bare in mind that SoGA isn't a free 6 year warranty on all goods! It's cover for products that were faulty at manufacture, but where the fault doesn't show up until later.

AEG seem to have made a reasonable offer. The fact that Pixmania is French could definitely complicate this; as mentioned, SoGA may in fact not apply at all - thus, if you pursue you may end up with nothing! (I'd recommend you look into this, as I doubt SoGA applies; although since they advertise for the UK market it may - check!).

Therefore, you can pursue with SoGA and the small claims court if you like and unholyangel advised you correctly of this in the first reply. However, it's a gamble. I think, to be honest, you're expecting too much. If you wanted six years cover for all faults/wear and tear then you should have bought a 6 year extended warranty in the first place; SoGA doesn't give you that for free!

I can understand you being disappointed that your fridge/freezer only lasted three years, especially since it was so expensive, however I'd advise you either take their offer or just put it down to 'one of those things' (and possibly avoid that brand in the future).
