New house purchase - condition house left in...

I made an offer on a house a couple of months ago, negotiated and agreed a price. All proceeding well, have had two more viewings to measure up. Exchanged contracts last week with completion next fri (23rd).
On my last viewing the present owner had already moved out (relocating and renting). There are a significant number of rawl plugs and holes around the house where things have been removed - even cheap stuff like coat hooks!

One of the questions my solicitor had asked was if he would make good on any holes left when items are removed and he confirmed he would.

Additionaly there is a descrepancy over bathroom cabinets, there are 3 rooms - Main Bathroom, en-suite and downstairs cloakroom. The contents sheet from the solicitor only mentioned bathroom and he agreed to leave the cabinet. However he has removed them from the other rooms (En-suite and cloakroom). Is this just tough as I didn't ask or is this an oversight of the solicitor for not ensuring each room is mentioned?

I have sent both issues to my solicitor who has forwarded them to his solicitor. With only a week to go, what is the likelyhood of a resolution? and what comeback do I have if he doesn't do the making good that he had previously agreed to? Can I withold some of the purchase funds?

    The cost of getting a solicitor to chase it will make it uneconomical I reckon.

    Ask your solicitor if they'll nudge them for you.

    I'm on a fixed fee purchase, so that isn't an issue. :D

    You're on a fixed fee for your purchase. I expect that means that the solicitors work is done once you've completed. I doubt in covers the cost of litigation after completion so make sure you get this agreed and finalised before completion or your solicitor can start adding charges...

    It won't

    But I'd be suprised if he/she wouldn't do a quick leter to the seller's solicitor for no charge just raising the issues to see if there could be agreement.

    if these are the only issues you have to grumble about .. i would just forget it.. do a bit of filling in and get on with life.....

    I agree, if that is it, just buy a packet of filler and get on with living there.

    Your solicitor has forwarded the issue now. If you get a good response, great. If not then your purchase fee will certainly not cover litigation and I can assure you that litigation is not cheap, but filler is.

    The cabinet issue is in line with the F&F form. If he hasn't said he was leaving items in the ensuites, they're not yours. Even if he said he would and didn't, it's still not financially worth pursuing.

    But surely it is not just filler.

    You cannot just fill gaps in and leave them as is.

    You then need to sand and repaint the area.

    I pressumed the vendor did not have the courtesey to leave touch up paints behind so the OP is now left with re-painting all the rooms that have had items taken from them.

    Could cost considerable time, effort and money.

    He could always hang something to cover till he's ready to decorate.
