Rented flat- help needed (urgent)

We have taken up a contract on a flat. A friend who is not on the contract also wanted to move with us. We allowed it on faith and having known each other for years and also convinced us that we do not need to add his name in the contract. WE WERE FOOL TO BELIEVE HIM.
But after we moved in, the friend decided to move out saying that the contract is not in his name. Have not paid the rent and deposit, but forcefully we asked to pay one month rents.
He said he will come back to pick up all his stuff which is still in our flat.
WE ASKED THE KEYS AS WELL AS WE DID NOT BELIEVE HIM AFTER THIS BETRAYAL BY HIM AND WAS WORRIED HE MAY STEAL OUT STUFFS AS WELL.
THE GUY DOES NOT ANSWER THE PHONE AND HASNOT COLLECTED HIS STUFF. IS THERE ANYWAY WE CAN MAKE HIM PAY TILL WE FIND ANOTHER FLATMATE.
IS THERE ANYWAY HE CAN ASK FOR THE RENT ALREADY PAID?
WHAT OPTIONS DOES HE HAVE IN GETTING THE RENT ALREADY PAID FROM YOU AND HOW CAN WE PROTECT US NOW-AS OUR NAME IS IN THE CONTRACT.
YOUR HELP ON THIS MATTER WILL BE HIGHLY APPRECIATED.

    No need to shout.

    If nothing has been signed, nothing can be legally enforced. Change the locks if he won't return his key. Vet your flatmates more carefully next time, and ensure they're part of a proper contract and that the LL knows about them.

    start again - how many of you moved in, now many are on the agreement, how long ago did the friend move out, how long have you been there

    He forced him to pay a month rent before he left - My question was can he ask for the rent paid to us.
    The contract is in 2 persons name and this concienced us that he will stay long term and was a good friend of ours.
    but decided to move out in 2days.
    Have left the flat but have not come back to collect all his stuffs.
    We asked him to give us the key, which he gave to us cuz we were scared that he would steal our stuff when he took his stuff.
    How can we protect ourselves in this situation - The guy who left the flat does not have the key and hasnot come to collect his stuff.

    Can we start with

    There are two tenants called A and B who have a tenancy started when? When does it end? What is the rental amouint and when is it paid?

    Someone else moved in when?

    And left when?

  • Sorry for the typing errors
    A and B took up flat and C also decided to join A and B. C convienced A and B that C will stay long term and no need to put C in contract.
    A,B and C all moved in happpy, but turned sour after 2 days. C decided to leave saying that C's name is not in the contract and not legally bound to stay.
    A and B did get 1 months rent from C before C left and A& B also asked C to leave the key, which C did.
    C left on 13 july and has not come back to collect his stuff till 16 July.
    A& B wants to get this issue resolved and called C many times but no reply.
    How can A and B protect themselves when C comes to collect his stuff and C may asked for the 1 month rent back.
    WHAT CAN "A" & "B" DO IF "C" DOES NOT COME TO COLLECT HIS STUFF?

    Well, as I understand it, A and B are legally required to pay the whole rent. Is the landlord aware of the plan to sub-let?

    if A&B were happy paying the rent before C came into the equation why would they want to keep his month's rent for 2 days other than pure greed?

    If it isn't going to work out, best to spot it early and move on, I say.

    If C does not collect his stuff, write him a letter saying you will dispose of it in 28 days, then sell it, then keep the money for him.
    Debt free 4th April 2007.
    New house. Bigger mortgage. MFWB after I have my buffer cash in place.

    Agree with Emmzi - A & B obviously are able to pay the rent without C's help. Since A & B signed the contract without C at that point in time.

    So why demand 1 month rent from C? Since he stayed only 2 days? Treat C as a guest....I think C was nice enough to pay 1 month rent for all the trouble C has put A & B through....
