Deposit Protection Went to Court

Ok so my landlord didn't protect my deposit. To save it going to court we used the Court Mediation Service, we agree'd with the mediator that the landlord will repay me my security deposit by cheque within 7 days. This was last thursday and I still have not recieved a cheque.

What is the next step to enforce payment is made?

    i suppose you could ask the court mediator to call him one more time .. but if that fails your only option is to

    take him to court - moneyclaimonline is easy and quick

    Your LL is clearly a charlatan who sees him/herself as being above the law on tenancy deposits.

    If you were wanting to pursue the issue of the non-registration of your deposit you should not use moneyclaim online.

    Let the Court Mediation service know *in writing* that the LL has failed to keep his/her word and that you wish to go through to a court hearing for recovery of your deposit. keep a copy of your letter.

    quite right tbs ... i had been doing a moneyclaim myself today and it was on mind

    agree with LL being a charlatan

    i have no faith at all in mediation - i have been twice - once the mediator called my claim a "stupid suit" - talk about a judgemental bombast..... and the other time the firm i was suing sent a lowly representative to the mediation session who had no authority to make any offers or settelement !!! efven the mediator was phased by that one....

    complete waste of time in both cases...

    i am finally evicting a woman who has been in arrears for 18 months and who had made intermittent attempts to pay off arrears, she had also stopped paying her top-ups... the final straw was when i gave her some cleaning work to help her finances and she wanted to charge me for 3 days, and 3 taxis to clean a 2 bedroomed terrace... taking the mickey came to mind......

    she has at times had her 4 adult children and a homeless single mother living there with 2 babies... even tho she is the only person on the AST....

    Wear and tear wont begin to describe what the house will look like when i get it back.

    The sad thing is that i gave her a tenancy to help her escape from her appalling landlord who owned next door (where she had been living) and who REALLY treated her badly....

    hey ho... thats life... you can only go so far ...

    it wont stop me helping others...

    If a landlord does not protect a desposit wit one of the three registered schemes for an AST, he can be fined up to three times the amount of the deposit which can end up being paid to the tenant.

    Has to be pursued via Form 208, not moneyclaim online/N1 - see post above. It's a penalty (civil law) rather than a fine and, if ordered by the court, *is* paid to the T

    Claimed mine fine with a N1 and that was only a few months ago when it ws advised to use a N208
