Can I cancel my order for the carpet and still get a refund?

I ordered some carpet to be fitted into my home and on numerous occations they have given me excuses as to why it has not arrived...ie, first, the carpet had not yet arrived then the fitting date was pushed back twice. Niether the product or service have been delivered on time.

This morning I recieved a call to tell me that the fitting date has been pushed back once more. I am not interested in dealing with this company any more (Carpet Right) and so I requested a refund, I was told that I would be charged for cancelling the order.

Am I entitled to a refund without paying the cancelation fee?

Did you state on the contract that "time was of the essence" ?
