I bought a book on the 22nd August and paid through Paypal.
The book has not arrived, I contacted seller and this is the reply:
"Hmmm - that's odd.... looks like it's got lost in the post somewhere.
What would you like to do now... obviously you haven't got the book, but neither have I so we've both lost out thanks to Royal Mail!
What I would be prepared to do is go halves with you on the loss and ship another to you (recorded this time!) if you would be happy to pay half towards it?...say £2.25? This will just about cover the postage I should think so you'll still be getting the book cheap?
The books normally sell at about £8 so I'm out of pocket selling at £4 anyhow, I'm just trying to clear some stock to make a bit of room at home. I don't mind losing out a few quid but I'd be down quite a bit if I just send out another one to you, so hope you understand asking for a bit towards it.

like they said at the beginning of the email, what do you want to do. What do you want to do? I would want a refund, then they can make the claim with RM, then ask them to list their other book and buy that one and get it sent recorded. The fact that they havn't sent it recorded first time would put you in a winning postion with paypal as they won't be able to prove delivery. Start your paypal claim now so as not to be to late claiming.0

It is not your fault that RM have lost the item, so do a paypal chargeback as you will win as seller cannot prove delivery.
The seller should have covered themselves against loss by asking for a certificate of posting, if they have done that then no one loses.
Personally I would now start a paypal chargeback, but also email the seller (after submitting the claim) being very polite and sympathetic and agreeing that RM can be a pain. However, go on to say that no doubt they have retained proof of purchase and can reclaim the loss from the RM so all should be OK.
If they don't have a COP I rather suspect they may have just posted the book in a box and not taken into account the new PIP rates, so it has probably been stopped somewhere. Again though that is not your problem but of course should the book turn up later, then you can just stop the chargeback.

Sound a little like he didnt post in the first place and as the book didnt make him enough profit he is trying to eek a little extra out of you (which if he does he is also avoiding paying ebay a bit extra on fees)
As said already you are entitled to the book without paying extra, i would insist on that, but offer to pay the additional amount to send it recorded delivery this time (only an extra 70p ish)

I would ask for either a full refund or another book if I really wanted it - but I wouldnt be willing to pay more money - its upto the seller to make sure that it arrives with the buyer. It also falls to the seller to claim from Royal Mail if the item gets lost - which the original item may have done - or the seller is trying it on and trying to get more money out of you. I would tell them if you dont receive a full refund or new book then you will proceed to a paypal dispute!
Whats the sellers feedback like - have they maybe been doing this a bit - have they sold many other items?Weight Loss - 102lb0 -

Never threaten a chargeback as it gives the seller time to clear their paypal account. Where a seller seems uncooperative start the chargeback before the seller is aware of what you are doing.
