online purchasing rights

Two weeks ago i placed an order online, at a site that now sells groceries. The order was for 2X 1.5 litres of Blue Comfort Concentrate.Today i received an email of them stating

We are writing to inform you that the price for the item Comfort Blue Concentrate Liquid Fabric Conditioner (2 x 1.5 Litre) was displayed incorrectly at the time you placed the above referenced order.(copied from email)


And that they were cancelling my order, i was just wondering are they able to do that or should they honor the order at the price stated at the time ????

    They can cancel whenever they like before they dispatch the item, as that is when the contract is confirmed.

    Contrary to the above advice, it isn't usually that clear cut, it depends on the exact details of the transaction and the terms and conditions attached to it. when money was paid, what representations were made and when etc.

    The details of the transaction are also important; whether it was obvious it was a mistake for example. It is likely that there is an argument to say that they cannot, but it really isn't worth it over such a debatable point. Is it worth the stress to pursue when there is no guarantee of success?

    For orders made online then yes they can.

    The reason for this is that in a shop, you would make your offer of payment in exchange for goods and the store employee would accept/reject it.

    When you place a order online it is automated and no one has had the chance to accept or reject it.

    You could however still write a letter and see if they are willing to honour it, however this would be a goodwill gesture rather than something you are entitled to.
