Hi all was sent this site by a friend hopefully you lot can help.

If there is any information in here that should not be here please delete.

I will try and explane best as possible.

I am employed by a company to go to site to repair equipment that ether Gas or electric.I use a company van (small one) so the van is owned by a lease company.

A job came in for a shopping retail place at Parkgate shaopping centre in Rotherham.

I do have a sign in my windscreen says engineer on call working on gas plus my mobile number

I parked in the same place i have for the past 3 years a yellow crossed area that has a dropped kirb (easy to move tools and parts etc)

Right next me are normal bays about 20 and allway round the large square area @ 50 spaces, plus infront an other say 500 spaces.

This place dont charge for parking as it is a masssaive shopping complex I.E. M&S, Dixons,BHS etc etc.

So the spot i was in didnt have anything to say i cant park there but is a yellow crossed area thus most contractors use it for ease of use and not to damage other cars around as its a large area (abound size of 2 cars)

There has never been anything ether on site or made clear by the company we do work for that there is now a parking ticket company opperating on the car park

I got a ticket for a company called TPS Parking Solutions Kettering.
It only says "out of bay" at the bottom, thats the reason for the ticket.

Do i pay the £40 which must be within 14days or £60 after?
If not what do i do and do i need to let the lease company know about it or just the company i work for.

Many thanks

Dave

You don't pay at all! It is a scam, you can ignore private parking tickets.

The biggest headache is that it's a leased van, Your main problem is to tell your employer and the lease company that this is a private parking charge, not a fine, and any alleged contract lies with you (the driver). As you know it's a scam you won't be paying it but you take full responsibility to handle any letters that they get sent from pseudo debt collectors, make sure they just pass all the letters to you.

The problem is that the letters look legitimate and will be sent to the registered keeper of the vehicle (not you). They might believe the scam unless you tell them now, up-front.

You only need to ignore a series of standard threat letters until they fizzle out. No-one's credit record is affected, not yours, not your company's and not the lease company. No-one will be taken to Court (the only possible alleged contract is with you as you were the driver - but it's a scam so don't fall for it!).

Show your fleet manager, and forward to the lease company, this Fleet News link:

    http://www.fleetnews.co.uk/news/2009/5/28/question-private-parking-fines-fleets-urged/30698/

You MUST take action to make sure the lease company does not pay this, it is NOT a fine. Their t&cs are highly unlikely to cover scams like this but they won't know the difference (probably) so it's up to you to tell them about this fake ticket.

Your employer cannot make you pay a fake parking ticket, show them this thread if they even think about it!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I would get a name and put it in writing after your telecon, that you had a private parking ticket which you are well aware are not enforceable. As the driver you take full responsibility but you will NOT be paying it. If they say any t&cs cover them to deduct/pay it, then ask for those t&cs immediately and post them here. They will almost certainly not cover them as this is NOT a real fine!

Give them the Fleet News full link so they can see what we know to be the case about this scam.

The more Fleet Managers who become aware of this scam the better. Or would they pay any old invoice that looks like a Council Notice to Owner that lands on their desk?! I could easily cobble one together, so could anyone (that's how private parking companies work).
