Still waiting for deposit back after 8 months

Two years ago my fiance and I moved in to a flat and paid the sum of £550 as a deposit. This deposit was paid to an estate agent who apparently passed it on to the company managing the letting of property on behalf of landlord. In November 2008 we were informed that this was deposited with The Tennacy Deposit Solution.

In December 2008 the property was repossesed by the mortgage company and responsibility for the management of letting passed to a large chain of estate agents by the appointed receivers.

In November 2009 we decided to move and after going through the usual checkout inspections etc., we were informed the property was in excellent condition and that our deposit would be returned to us within two weeks.

We are yet to receive our deposit back. Since then we have contacted both the managing agent and the receivers and have been informed by both that the other party holds the money for the bond.

We are now at a loss as to what to do. We are awaiting responses from the deposit schemes as to whether they still hold the money. Is there any way that we are going to get our money back?

    write to your ex landlord (he is responsible in law) - letter before Action - give him 10 days to repay the deposit otherwise you will issue a summons against him in the county court.. but . does he have any money.... its easy to get a court judgement ... much more difficult to get the cash out them....
  • We dont actually have any contact details for the landlord. The original tenancy agreement has the landlord's name on it but no contact details. All contact was to be made through the property management company. This company has since has ceased trading.

    I've heard back from Tennacy Deposit Solutions this morning and they have informed me that they have never held a deposit for the property in question.

    you cannot take yoru landlord to court without an address.. look on 192.com and all the social media sites.. facebook.. twitter etc etc ask teh neighbours.. or employ a private investigator
