Re: Tennants in common, considering split, percentage changes?

Hi there,

I did a tennants in common (I think!) with a percentage split 3 yrs ago now to buy a new property with my OH.

No one would of forseen any problems but I am now not feeling things are great, when I offer to pay for things i'm told to "spend it on yourself" & not the house and yet they are forever paying for things and upgradin, keeping all reciepts but not letting me become involved.

Other things are also not rightand I'm starting to wonder what would happen in the split. My concern is that I have read a few cases where if the person can proove they have paid more to the house to increase the value then they gain more??!

I really don't want to be screwed over as such, can anyone let me know if this is true etc.

    You do not need to think, you need to know whether it is joint tenants or tenants in common. Check and then come back.

    Tennants in common, it's not 50/50 it's different shares between the 2

    My oh has spent around £3k on a conservatory and obviously has not asked for any money saying were in it together, kept all reciepts, this would increase property value but can he be nasty and say not entitled to as I never kept reciepts for what I buy ie everything else!

    Do you buy everything else though? Do you pay all the bills without contribution from him? Do you buy all the food?

    I buy most the food each week and bills are 50/50 even though i only own a small part of the house

    Then you don't pay for everything else! How can you say that you do? It doesn't matter if you own less of the house, you still use 50% of the utilities. How old are you and how old is your OH? How is the equity split?

    Can I ask why my age is important? And I didn't say I pay for everything else, I said we split it 50/50 even but I buy the food every week. When I said "everything else" I mean that I have never kept any reciepts for the things I have paid for over time. I'm asking as I want to know if they would then say that my oh has paid for more than I have as he has receipts when I have nothing except bank statments

    Part of the forum rules I thought state that although advice is mixed you still had to be polite. No there is no 'age gap' and no I don't believe I am immature?! Not sure how this can be assertained from me asking a question, I have not judged you have I? And I think that would be a waste of ones time.

    The things I do buy are a mixture of removal and not, it's hard when you live with someone you don't expect to have to account it when you seperate therefore you do not list nor keep proof as such. I've paid for rennovations, food, vet bills allsorts but my point being I've never kept proof as you don't plan to split with your OH? The main point being was that the conservatory would have increased value for the house, does this mean I wouldn't get my %?

    Fang has a bit of a reputation for being blunt to the point a rudeness over several forums here and off-topic sometimes.

    I suggest you come back tomorrow when more folk are around and hit the ignore button if you do not want to deal with him.

    It would help people if you indicated what percentage of the property in in your name (as should be listed on the deeds if this is tenants in common).
