OK - it's a little complex and franly I think you should really get some proper legal advice (free half hour is often offered by solicitors) - but number one - if HIS debt defaults and they put a charging order on the house they can ONLY put it on HIS half of the house, depending on the joint status (that bit always confuses me...).
On the other hand in your divorce is there any arrangements for who takes on what debt? It has been known for judges to agree to split debts between partners so that a joint debt becomes the sole responcibility of one debtor. I'm certain I have come across it on here before...
The creditors weren't too pleased but had to yield in the end. I really would recommend you get some specialised divorce legal advice...DFW Nerd #025DFW no more! Officially debt free 2017 - now joining the MFW's!

Thanks MrsT. Am going to CAB about his c.card charge. Divorce is ongoing - he has just signed & posted the first letter (so he says), this has taken him since end of Jan. Hopefully nisi is on cards. Will I be eligible to get back dated maintainance as I feel he has deliberately been stalling? He has also not contributed to mortgage for at least a year - I have paid and my salary is 1/3 of his! Hence the debt but at least no arrears for mortgage. Do judges take this into account at all?0

Will not be back. Thanks to all help/advice given - will follow it up. Friend's husband has just died suddenly and it's my turn to now help her through this. My problems are only minor compared to hers and family.0
