refund of newish mobile phone

Hi MSE followers,

I have a new 5 week T mobile phone (bought 21/5//10) that has developed a fault ie wont charge up...in fact just drains the battery...now will not come on...both shop and online services not helpful...said can have a repair only...not happy with this, no confidence in build quality or longevity of the phone so would really like a refund and look elsewhere...I believe I am w/in my rights to request from T mobile for a full refund ?? comments appreciated....thankyou Andy

    7 weeks by my reckoning. They are within their rights to offer a repair. You can ask for a refund...but they can say no!

    Above is correct, the time to reject an item as inherently faulty and getting a refund is 'reasonable' 5 weeks is normally accepted as being over the reasonable period and as such a repair or replacement at the stores choice.
    The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!

    Hi...T mobile called me in response to my issues...They have offered a replacement instead of repair which I have acccepted..I didnt discuss any refund. thanks for help.
