CSA Hell advise needed please

I have been fighting for two years now to get a reasonable amount of child maintinance for my three girls...i have just been awarded £22 a week...the csa refuse to believe me when i say my ex partner is working cash in hand and is self employed...i have been through my mp and the csa..and he has had a defualt notice in place...i feel like i want to sue them!! they have advised me i can come back in a year to review the case. So my children suffer until then with no money to live on from their father...i can prove he is working...but cannot afford a private detcective to follow him as i was also left in thousands of pounds of debt by him also....By law you HAVE to go through the CSA...it is failing my children...what more can i do?? i havnt written a letter of complaint yet...any help much apprciated x

    What evidence do you have? this is crucial, as you could apply for a variation on the grounds that he has a lifestyle inconsistent with declared income. You will get it rejected, but you will need to appeal and go for a tribunal hearing. You do however, require lots of evidence to his lifestyle and what it would take to fund it. They need evidence to do an assessment on, and unfortunately, self employed are able to manipulate their income to suit. My ex declared c 9k gross income to the inland revenue, but then declared he earns 36k to the mortgage company! Got found out when he refused to provide a copy of his mortgage application, so the tribunal chairman decided he had something to hide, and said he earned 30k instead of 9k.

    The CSA (its working practices, staff and systems) are well known to be defective and unfit for purpose. To a certian extent one must accept this when dealing with them.

    If you believe your case is being badly handled then you should complain without hesitation, in writing. And dont back down, stand your ground. Take the time to put together a comprehensive complaint which addresses every single problem you have with them. Dont let them fob you off with excuses etc. Once they have dealt with your complaint they should signpost their letter so you know how to ask for a review of it, and once thats done if you are still not happy how to go about opening a complaint with the ICE.
    When dealing with the CSA its important to note that it is commonly accepted as unfit for purpose, and by default this also means the staff are unfit for purpose.

    I have evidence based on him taking my children to work with him, also have taken photos of him in the company van!! Also my past job where i worked he was a regular at delivering to the pub also and many other pubs too, which he has denyed any knowledge through to the CSA. I have already reported him to the HM Tax fraud office too, but there investigations take time, he declared he only earned £4000 last year, which is not sufficeint to pay his huge credit card debts also and his lifestyle..he has been to Eygpt too, His girlfriend payed for this and has taken the children away twice on holiday too!! He is one of those little cretins who is totally making a mockery of the system...and i do not know what else to do..its having a massive affect on my health trying to keep on at the CSA and MP, its as if i have to become a private detective to prove my childrens right for maintinence...£1 a day per child is Criminal, there are children in third world countries that have more to live on than my children :-(

    Instead of spending your spare time following him around, you could always use that time to work so your children would be better off.

    have you tried coming to a private arrangement?

    your anger will only stress you out and consume you even more. and probably make him dig his heels in even more. (i know it did with me.) and TBH if he is SE then you're gonna be getting a while lot more stress and have a lot of time swallowed up pursuing it. valuable time you could be spending with your children.

    the csa put an awful strain on already frail relationships. all i'm saying is, could it be worth looking for another way to skin the cat??;)

    I have to agree with you in some ways, I dont support benefit spongers.

    But

    This is child maintance so its slightly different. Her ex has a legal and moral responsbibility to pay appropriate maintance. If he is trying to avoid paying it then I support her for pursuing the matter.

    Even if she was working full time etc the non resident parent would still have to pay maintance.

    Lol.. yes i do work and im not a benefit scrounger in any way shape or form, my children are happier wihout him being here, he was a violent control freak and many a time i was taken off in an ambulance..when i eventually got the strength to move on with the help of the social services, help of my G.P and everyone else that offered me the help to re-build my life for my children..i took it, ive had two injuntion orders to keep me safe and he proved to show the man he really was to kick in the windows of a car with my children sat in it.. im a strong person now to what i was, gone back to work full time once again and i firmly believe that he should pay towards the upkeep of his children and nothing else..they are the ones who are suffering as i was also left with alot of debt from my ex partner too... i struggle.. but they are missing out not me :-)
