    Sought legal advice and I have to pay money back :( , but I have spent it so:Would I be able to request paying in installments or would they expect the £5000 in one go ( I do not have this kind of money)?If they ask for the full £5000 and I can't pay what happens?Thanks for all the advice so far, it is really nice to know that there are people out there who care and give their time to help others. Thank you!Dave

    Yeah she left just over £5700 so i should have known, but i was too upset to think straight to be honest. It's hard to think legal and logical when your heart is breaking.

    The debt is enforceable for 7 years.

    If the executor did not advertise then he/she is personally liable

    If he/she did advertise then they have to go after the beneficiaries - which can be difficult.

    Payment in instalments is always a possibility.

    If your Mum did not leave that amount anyway then the full amount is not payable - only what was left after funeral expenses - and is shared proportionately with other bills. Which if they've alreay been paid is difficult again.


    It is to be honest a debt that the executor should have chased - ie asked for confirmation as to whether it existed or not.

    I was the administrator, there was no will. Problem was I didn't know what was goning on too much I was tooo upset at the loss of my mum.

    Well they can't have what you dont have. Tell them your administration as bad as theirs & it will take you as long to pay as it did for them to send out the bill.

    Could you clarify what your mom was paying for? I mean why was her care not being fully paid for, was it because the care home cost more than social services were willing to pay.

    When she went into the home she never received any bill even though I asked many times if she should be paying something.They didn't bother to do anything.

    I agree with all that the other forum members have said, but I can go back to my original question about funding. The first home my mum was in sent out a bill of over 2K for 3 months care. The first 12 weeks were disregarded so that meant 2k for 1 month. This was because social services hadn't got their act together. I find 5K an incredible amount to be in arrears. If your mum only left 5.5k this means the state should have been funding approx 90% of the cost.

    I can appreciate how grief makes people react, you just want to get it all sorted and put it behind you. The loss never goes away, it just gets more bearable.

    I hope you don't need to find the full amount. You need a full explanation of how this bill is made up. If I am right you are being overcharged.

    Please take my advice at face value. I am no expert in these matters, I am just quoting from personal experience.
