Help Needed.

Me and my girlfriend moved into my moms house 5 years ago to help her out as she was struggling to pay the mortgage and we wanted oput of our flat. Since then my mom left to live elsewhere but let us stay here while we paid the mortgage every month.
We have 2 kids and another on the way and as i only get ssp if im off sick even though im salaried we cant afford to pay the mortgage this month. Ive told my mom and we have said she needs to move back in and we will register with council to get our own place.
Our problem is by leaving the house with us in it my mom has made us tennants by default but had no tenancy agreement or nothing. We were just paying the mortgage in her name.
Now when filling in forms there asking for landlord references which we cannot provide without getting my mom into trouble and obviously we are trying to avoid this.
In the eyes of the law im not sure what our situation is so can anyone offer any advice???

Is this just a short term dip in funds? Can mum afford to step in and pay the mortgage? If so, can she not just do so and allow you to stay there until things pick up and you're back at work and you pay her back later?
If you need a longer term solution can you not just say you when you are going for the council place that you were living with family (do they need to know that mum wasn't there) but that you now need to move out because she can't afford to have you there as you are unable to contribute financially to the household.0 -
Problem is shes living somewhere else and paying council tax so they will know shes not been living here. Im back at work but my arthritis has been playing up lately and as it stands I cant claim housing benefit when off sick as Im not a registered tennant and I dont pay rent exactly. Its a very sticky situation.
We are registering with the council and saying my moms moving back in but they will only class us as low priority as as it stands we are adequately housed.0
