Clamped by Private company AM Secure Services

Hello Everybody,

I am new to the forum and need your help with a clamp fine.

I was parked up in a "private car park" I went in to pick up my girlfriend from work, I came out 5 minutes later and my car was clamped!

I tried everything to get out of the clamp there and then, but I couldnt, I checked the person who clamped my car he was SIA registered and I have already checked his number.

When I phoned up to pay the release fee, I made sure that I said several times that I was paying the fine under protest and to make sure that is was written down on all documentation, the guy on the other end of phoned agreed, but wether he actually did it or not I will find out.

When the clampers came back to release me the guy on the phone had already told them I was being differcult, and they told me they were recording everything I said to try and scare me. But that was ok because me phone was already set to record my conversation with them.

They wrote out my reciept and gave it to me to sign, I ask them where I could write on the form that I was paying under protest, this is when the guys got very aggresive and said if I write anything else other than my name and sigunature on the receipt they would not give me a copy of it! After arguing with them saying it was my right to do so, and recording it all, I sign my name as I need the reciept if I have to take them to court.

Before and after this was going on I have taken photos all my surounding and parking bay and warning signs, has you can clearly see in the photo below, the "parking bay" I was Parked in was not clearly marked, had no solid white lines and I had no idea when parking it was a "pirvate parking bay".

Do you guys have any advice for me? Do you think I can take them to court and win?

  • Guys and Girls I think I may found a very clear way to get my money back for my illegal clamping.

    Right on the Parking notice sign it CLEARLY says "Vechicles not displaying a valid permit OR a valid tax disc maybe issued with a parking charge notice and/or immobilised and/or towed away".

    And it says CLEARLY on the clamp release receipt that the "Nature of Contravention" is NO PERMIT

    So my thinking and please say im right, is that using the word OR in statment saying that I have to Diplay a valid permit OR valid tax disc, means that my car, which DOES have a valid tax disc, DOES NOT have to show a permit as the word OR has been used, therfore the reason for clamping is invalid thus illegal.

    What do you guys think?

    Unauthorised = no permit I would have though unfortunately.

    pity you did not continue to insist on writing "Paid under duress" on the receipt as non issuance of a receipt would have been a great help when you do a county court claim (or letter of notice before action)

    Your signature is your own, you may write it as you wish on any document.

    for example
    F.Bloggs. All Rights Reserved. non assumpsit

    or as a short form
    F.Bloggs. A.R.R. non assumpsit

    I would caution careful use on official documents. However in these circumstances I would not hesitate to sign in this manner.
