Won item over a week ago, seller still hasnt dispatched

I won an item on ebay on Saturday 3rd July, seller has 100 % feedback and auction said item would be dispatched next working day after receiving cleared payment..therefore I hoped it would be posted tuesday at the latest..on thursday I noticed seller had marked the item as dispatched and was really hoping to have received it by Friday..but item didnt arrive.
Today I have emailed seller..and had the reply that seller had been ill with a cold and had been unable to get to the post office and would aim to post item on weds.
Im quite miffed tbh as the item was a present and It will now arrive too late..I think its a bit off that the seller didnt even think to send me a quick email to say it would be delayed..Im afraid a cold is not a good reason to not communicate by email..
I dont really want the item now as I will have to go and buy another in town so I have it in time..shall I do an item not received or am I being a little mean?

I would tell the buyer that you no longer need the item & ask for a refund as you can't wait any longer for it. You don't want it posted now or else you'll need to send back tracked to get your refund.
All in the nicest possible way, of course.
If you do an INR the chances are the seller will post it before responding, leaving you out of pocket.0 -
Pretty bad form not to let you know it was being shipped later than stated. As hermum said try messaging the seller explaining you bid on the understanding it would be posted as stated in order to arrive when you needed it, be as friendly as possible to secure the refund even though it's obviously a huge inconvenience and disappointment, I'd be pretty angry if this happened but keep it nice to get your money back in the painless way possible.0

I hate it when this happens. A cold does not stop you from logging on & sending a polite email apologising for the delay (then again a cold wouldn't stop me from going to the post office either!)
I recently was told to have some compassion when my item wasn't sent due to a "bereavement". Yet they were able to get online & list items in the mean time. All it would have taken was a message advising me of the delay.0 -
The cold also did not stop the seller from marking it (incorrectly) as dispatched.0

so I can go out today and buy a replacement..and have it in time for when I need it.:D0
