Help with DLA night time care needs

Hello

This is my 1st attempt at filling in theese forms, it was previously done by my husband who passed awawy 18 months ago.

I have just had me renwel reduced from high rate care to middle rate they say i dont have enough night time needs to get high rate. ihave had high rate care for the past 8 years and its only since i have filled in the forms my self that i have had it reduced im sure i must have missed something that my husband would normaly put down

im just wondering what quialifies as night time care needs. the ones i listed where help , getting to and using the toilet which takes 20-30 minuets.

This is whats listed on the form

I have difficulty or need help:

• turning over or changing position
in bed
• sleeping comfortably
• with my toilet needs
• with my incontinence needs
• taking medication
• with treatment or therapy

I was told by a friend that you dont actualy need to recived help for theese things what matters is that you have difficulty with them is this true?

If thats true then i do have difficulty getting comfy and turning over in bed its very painfull, also getting from a laying down position to a sitting up position to enable me to take painkillers is very painfull but i never have help doing theese things.

My friend also mentiond that if there was a fire in my house at night i would be unable to get out of the house due to my mobility needs.

Theese are all things that make sense once mentiond but i would never thing to put them down myself which can make of breake my claim.

I suffer chornic arthritois in both my hips, do you think it would be worth me appealing? if so could anybody give me any more tips or examples of night time needs that i may not realise are worth putting?

    You need to have the needs for at least 5 nights a week. The help just had to be reasonable - you don't actually need to be getting the help.

    First, I want to say sorry for the recent loss of your husband. Second, I believe it is possible to get a copy of your last DLA application form, so that might help. Not sure how you go about this, sorry. I am about to look into myself

    You need to phone up the DLA unit on 08457 123456.

    I would not risk an appeal for mid care to high care myself.

    An appeal can go down as well as up you know.

    i agree with this, otherwise i would have appealed


    i think im entitled to high rate care and low rate mob (based on everythin ive read) , but i only get mid rate care at the moment.

    too scared to appeal in case i lose it all
    2 esa medicals passed successfully (support group - it can be done!!)!! :j

    it is very unlikley u would lose it all,,when I phoned up for a help with my care needs,,the gent was very nice ,,he sent out the forms and I was told only to fill in the parts that applied to me,,which I did,,sent away,,and they upped my care to HRC,,not a problem at all

    do you really think it might be worth it?

    im terrified of losing it.. my dla would be gone and my disability premium if i lost :(

    Tell the truth, you don't need "tips". You can ask then to re look at your claim again, if they come back with the same rate then you can appeal and possibly get help via the CAB.
