Fine from DVLA

Hello
My partner forgot to tax his car in January, a couple of weeks later we realised and it was done immediantly (so 2 weeks maximum where the car wasnt taxed).
Today we recieved a letter telling us we had to pay an £80 fine for the car not being taxed (7 months after retaxing the car). Or else we will be taken to court (it is quite a threatening letter to be honest)
Phoned the DVLA to query this and their wonderful customer service reputation just shone through.....'its a 3rd party company dealing with this, nothing to do with the DVLA'. Would of had a more helpful conversation with a brick wall if im going to be honest
Phoned the company they wont discuss anything over the phone and i have to write a letter.
Should i pay the fine or appeal?
