Advice needed with Letting Agents

My family and I were given notice to quit our current property by 8th August, but since being given notice to quit my mum died of cancer, which has really knocked me.
My wife was hospitalised with a sever kidney infection which spread to her blood. She has just come out but has been ordered to have 6-8 weeks bed rest.
I asked our letting agent for a couple of weeks extension due to what has been happening and they have refused. I only wanted the extension so I could make sure the house was cleaned.
My question is what can I do? and where do I stand legally?

legally speaking you do not have to move until a court issues a judgement saying that you have to move by x date... this could take 2-3 months of your LA's time and effort ... even then you dont legally have to move out - the LL has to go back to court to buy a Bailiffs Warrant and the bailiff will turn up about 3-4-5-6 weeks later depending on how busy he is....
I would write a letter explaining your circumstances and ask for an extension of 2 weeks until x date....
if they refuse again... stay put.... what a shower
can you contact the LL directly and explain your circumstances and ask him/her directly ? ... your LA has to give you your landlords contact details if you ask in writing....0 -
What clutton said. Them asking you to leave is only that - asking you to leave. Only a court order obtained on the basis of a valid notice (eg section 21) means you have to leave, and only a court bailiff can make you leave physically!
Contact the LL directly, copy EA. Say that given your personal circumstances you were shocked and disappointed by the lack of flexibility or even basic human care shown. State that whilst they are welcome to serve you with notice to leave, you will not be leaving until the 2 week later date you have chosen and you would hope that you could exit the tenancy on fairly amicable grounds as a result of the fact that you have tried to be as communicative as possible of the situation and that you will be fully co-operative otherwise.
If they try to harrass you out, tell them that you will report them to the police for illegal eviction (which IS a criminal offence, although the plods sometimes don't realise that and it might need pointing out) if they don't leave you alone.0 -
Thanks for the advice. I asked the letting agent to let me speak directly to the landlord but they won't let me.
Thankfully we have a house to move to now and get the keys on 2nd August. But the landlord still will not budge and wants us out and if we do stay put so we leave it in respectable condition they will charge us £28 per day rent and proceed with taking us to court.
I really feel like just leaving it as I dont need the hassle but I really need most of the deposit back so really have no choice.0
