They refused ESA please help!!!!!!

    anyway I spoke to my friend today and she suggested to get finanacial separation as I really wont be able to provide for 3 of us that will place him maybe in better position.but do not have idea how to get financial separation ??????

    If you live together and are a couple you cannot have financial separation as far as benefits are concerned.

    This is not good advice. If you are together and living together as a couple then that is how you are based regards benefit.

    I know its hard if you take kids out of nursery because they will loose there space but in a weeks time with the summer holidays coming up im sure they could sell your childs place on a temporary basis!

    If he is at home, get him selling some bits on ebay to raise some money!

    NI is based on how much you earn per week. So, if you have one week where you earn £200, you pay NI; but if you have a week where you only earn £75, you won't pay NI.

    The OPs husband is self employed so the rules for NI are different in his case.

    For low earners (earnings below £5,075 per annum) then a Small Earnings Exception can be applied for meaning the person doesn't have to pay Class 2 NI conts.

    You are correct in that he can apply for Class 2 exemption. However that also means that he will only get NI credits which will go towards a State Pension but not for any illness related benefits so any ESA claim would be income based, whereas had he paid Class 2 NIC, he could get contributions based ESA.

    Getting financial seperation is a big thing and you're going to have a problem doing it especially if you've mortgages, loans, credit cards or bank accounts in joint names.

    To be honest, if my wife suggested that to me I'd be extremely hurt by it as it basically means the "in sickness and in health" was a lie and you wanted me more for the money.

    besides which, he will be back on his feet in 6 weeks

    financial sepration might take that long, and any benefits claim even longer
    2 esa medicals passed successfully (support group - it can be done!!)!! :j

    well we came back from hospital and they said no going back to work for ate least 4-6 months now!!!!

    that out him really low specially i am due give birth in 3 months.
    now questions is regarding NI contribution and 6 weeks penalty.

    if i pay now L200 will they start considering again ESA and possibly other benefits later?

    Out of curiosity, why do you type the letter L instead of the £ sign? Or am I not getting something here?
