Haunted by the past!

Hi there hope someone can offer some advice.

I separated from my husband in 2006 but he did not move out until 2007. I have since moved on but apparently my finances have not.

I moved out of the marital home during the divorce into rented accommodation and the marital home was sold to cover joint debts etc. I had my mail forwarded and have been listed on utility bills and council tax registered blah blah.

Unbeknown to me my now ex husband whilst I was still in the marital home stopped paying direct debits (sadly agreements in my name) which were paid out of his account for the council tax, a Play Station on interest free credit and an internet connection.

I have never received any demand letters from these companies to say that I owed money and have never tried to hide my whereabouts. I am now receiving, three years on, letters from debt collection companies for astronomical amounts (£700 alone for the Playstation).

None of this was disclosed by my ex husband when we settled the debts in the divorce through the sale of the house - he never said he had stopped the direct debits.

Is there anything I can do???

    I don't know if there is anything you can do about getting XOH to pay up. I guess it depends on the settlement you made with him during divorce.

    It seems strange that you have had no correspondence since you moved even though you had mail forwarded.

    The one I would sort out first would be the council tax. I would speak to the council to determine what would normally happen in this situation. If you do owe the money, see if they will take back the debt and you can work out a repayment plan with them.

    I would also get your look at your file on the CRAs to see if there is damage on there. See this article on how to check http://www.moneysavingexpert.com/loans/credit-rating-credit-score#files

    Someone should be along soon to advise about the others (the internet connection is a service, but the other is a credit agreement). You may want to send a 'prove-it' letter to confirm that the DCA really does have enough evidence to say the debt is yours.     Ok for the Council Tax you need to phone the council ASAP and explain what's happened and see if you can agree to repay them directly as this is the the most serious debt you can have in terms of consequences.

    Then for the others I would suggest you send them the prove it letter.

    I have had an issue with a DCA (debt collection agency) adding money to my debt recently. I sent them a copy of the prove it letter HERE with the phrase
    I have no knowledge of any such debt being owed to (company)
    changed to
    I have no knowledge of any debt of that amount being owed to (company)

    It has been almost a month and I have not heard back, but I have been advised by another member that a DCA has no legal right to add to the debt. The issue I'm referring to is written about HERE if you wanted to look it up.

    I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
    (Ok, one of them is powerless, spiders can be nasty.)


    As of the last count I have cleared
