double cover on home insurance

Hello , I have this linked at the end of my original esure problem but I thought I would start a new thread just to ask this question.
Basically I left Esure (contents insurance) and they continued to charge me. They have now said that if I can provide proof that I was insured elsewhere then they will waive the charges (£37)
Well I can prove I was covered as my Kwik Fit policy started 1-5-10. Unfortunately the renewal date with Esure wasnt until 24-5-10. Therefore I had two policies running at the same time....is this an offence?
I bought the Kwik Fit one over the phone as I was buying car insurance too and got a really good deal. In doing this I guessed at the start date and never really thought about it again.I then proceeded to cancel with Esure.
If I send Esure proof that I had another policy running for the last 23 days of their one ,will I be in trouble or is it allowed to overlap at the beginning /end of the term?

I have looked around and can't see anything although on Nationwide's insurance site they say:

Also found this thread: http://www.thestudentroom.co.uk/showthread.php?t=1077723 which seems to say in the case of an accident it gets complicated but isn't illegal.Always check to see if you are covered elsewhere
You cannot make the same claim twice, even if you've been paying for duplicate cover.
Also this: http://www.myfinances.co.uk/insurance/ask-the-expert/insurance/two-car-insurance-policies-$1308214.htm which again says that in the case of an accident it would possibly invalidate the insurance but since you didn't have an accident during that period then it should be ok.
I wish I could find a proper legal reference for you (instead of other advice sites) but I cannot.0 -

I will write back to them with the facts and hopefully that will be the end of it. It was a genuine oversight and it was my money I was wsting ,not theirs!
