    Thank you for your wonderful help. Another sleepless night but just to say in the email and the letter I sent yesterday I said I rejected the bike but not under DSR so should I send another letter/email saying under DSR as I have had the bike a week tomorrow? Also I havent metioned sec 75 or wanting giving them 30 days to send me a refund, although I did say I wanted a full refund.

    I wonder if someone could tell me if the last thread was okay with regard to not having quoted the DSR but rejecting the bike? Also I have just had a reply to the email I sent them this morning quoting the DSR. First reply they have sent. They say I have to send a photograph of the wheel, even though I have said three times it is pointless as you can only see the wobble when the bike is moving. The also say I didnt sign as in good condition, but I did sign as unchecked and that I did not report the damage in the 3 days. I did ring about the missing pedals on the Friday it was delivered, also rang on the Saturday about the missing pedals and bent parcel rack but was still waiting for pedals so couldnt try the bike out until the Monday when the wobbling was noticed. I emailed them twice no reply and rang 3 times. If I am quoting DSR and not SOGA am I still okay. I dont see why I should have to unwrap the bike again to take another picture that wont tell them anything anyway, when they told me to bubble wrap the bike back up! Any help would be appreciated. In the last couple of minutes received another email asking why wont I help them and take the picture. I have replied saying its not that I am being unhelpful but the picture wouldnt be of any use as you can only see the wobbling when the bike is moving. I dont understand why he is being so insistent?

    write back & say rejecting under dsr - no need for photos - tell him that you want refund within 30 days - tell him that you have also reported this to cc under s75 & refusal to refund under dsr.

    Agreed although i would say "I am rejecting the goods under the Distance Selling Regulations due to the goods being faulty".
    And as above poster said, under the DSR, they are obliged to give a refund within 30 days of your notice to cancellation - which was received by then on xx date so you expect your refund no later than xx date.

    Do you don't actually have to give a reason thou - it could be that the OP decided that he now wants a red bike instead of a blue one ....

    Mind you, giving a reason like you suggest should stop the supplier attempting to charge for picking it up.

    Yeah that was my logic. They should be responsible for return fee's so it may help him if they tried to sting him for that :D And of course keeping the pictures he has detailing the damage.

    Then again, i've said many times i dont trust anyone anymore! Too many times i've expected people to behave as they should/do what their job entails and too many times i've been given the short end of the stick. So i always make sure my back is covered now :)

    Just to update the fiasco this has turned into. They have collected the bike and I still havent had a refund. I have a receipt to say the bike was collected. I rang the credit card company on Friday to say I wanted to fill in the section 75 form and the man said he would send me one but nothing has turned up. I have just rung Barclaycard again and the lady has said I have to get a credit note from the company to send to Barclaycard, can you beleive that! I said but I am in dispute with them and I need to fill in the section 75 form. She said she would go and find out and she never came back, kept me hanging on for ages. I am at a loss now what to do. Why is everything so difficult. She could barely speak English which made it even more difficult. Any ideas folks??

    Hi,

    I suggest you ring back - you have all the emails from the supplier & the ones that you sent to the supplier, so have lots of proof ... ask them to send you the s75 form .... don't take no for an answer -

    Also call the supplier & ask when you are going to get a refund - I believe that they have 28 days from pickup - tell them that unless you receive a refund with 7 days you will raise a s75 cc dispute.

    One thing - when did they take bike back - you are not giving them much time to refund ....

    Hello, the bike shop have 30 days to refund (they are supposed to refund as soon as possible, but I would give them a chance to do it in the next few days) after you told them you didn't want the bike. They can't charge you for the pick-up as you were rejecting the goods because they were faulty, not because you just changed your mind. I would try and be as polite as you can, they have picked up the bike, :Tso that bit is done, and hopefully they will do the refund and you won't need to bother with the section 75.
