Card fraud and protection against it.

Hello all,

Recently three members of my family have been victim to card fraud, including myself. It happened to me with my credit card and my mother and brother with their debit cards.

When I rang Barclaycard they were not very helpful, trying to sell me some fraud protection for £70 a year if I remember correctly. I pointed out that it should be protected anyway, they really went for the hard sell....but all I needed to do was fill in a claim form and they refunded the money.

Now my mother is having the same problem on her debit card with £150 used at a garage none of us have heard of or live near, she rang the bank and got the same thing trying to sell her fraud protection.

Does anyone know if you are covered against fraud without this? As far as I know credit cards are better protected than debit cards, well, that's what I heard.

    Under the provisions of the Payment Services Regulations 2009, unless the bank can prove that you have acted fraudulently or carelessly, they must refund the money immediately whilst they investigate the matter.

    Regulation 61 specifies :-
    Payment service provider’s liability for unauthorised payment transactions

    61. Subject to regulations 59 and 60, where an executed payment transaction was not authorised in accordance with regulation 55, the payment service provider must immediately—
    (a) refund the amount of the unauthorised payment transaction to the payer; and
    (b) where applicable, restore the debited payment account to the state it would have been in had the unauthorised payment transaction not taken place.
