reclaiming bank charges from Santander

I have been in the process of trying to reclaim substantial bank charges from Santander since 2007 (before the announcement of the high court test case). Recently I have referred my battle to the FOS who have written to the bank on my behalf this week. Today I got a phone call from Santander saying that they would refund 3 months worth of charges however due to the findings of the high court they would not consider the previous 6 years worth of charges and they would be sending out a letter to close the case.The ombudsman have said that I need the closure letter so that they can pursue their investigations on my behalf.I have put forward a hardship claim. I have accepted the 3 months refund on the phone so that I can get the closure letter to send to the ombudsman but I do not accept this as closure. What about the rest of the money that has been stolen from me??Any advice on what to do next???Have I jeapordised my chances of getting the rest of my money back by accepting this? Should I write back to Santander to say that I do not accept this payment after seeking furthur advice??Has anyone else been in this position??

Nothing has been stolen from you. If it has, report it to the police.
The FOS will only consider a reclaim of bank charges on financial hardship grounds; it's not guaranteed and any refund it suggests certainly won't go back 6 years. (about 6 months is typically the maximum)
