Returning faulty item to a shop, what rights do I have?

Hi,

I ordered a waterbut with stand from Tesco Direct online and opted to pick it up at my local store to save on postage.

On Wednesday I picked it up and took it home all wrapped up tightly and sealed in a plastic bag (no box). When I unwrapped it, I found the stand broken. The strange thing was, there are 2 bits of plastic that are broken off but they are missing. So they have packed the item up knowing it was already broken.

Phoned Tesco Direct and reported the fault and they said they would have a replacent sent to the store for Friday (today).

I am going there this afternoon just to return the faulty item and pick the new 1 up, but I won't be doing any shopping there.

What are my rights for making a special trip to return this faulty item for a replacement? Can I claim petrol costs?

    Why is this different from long distance selling, when sellers have to pay for delivery costs for returning faulty goods and replacements??? NOTHING! So my question is a valid one!

    Anyone that can give me an answer to my original question, I'd be grateful.

    Pretty sure that answers your original question.

    Edit: Distance selling would cover the cost of return postage, not the cost of you driving it to their depot / shop.
    Thinking critically since 1996....

    Because you didn't pay for delivery costs and they didn't post it to you.

    You should certainly ask, SoGA says you should, and as the goods are faulty SoGA will apply.

    48B Repair or replacement of the goods

    (1) If section 48A above applies, the buyer may require the seller—

    (a) to repair the goods, or

    (b) to replace the goods.

    (2) If the buyer requires the seller to repair or replace the goods, the seller must—
    (a) repair or, as the case may be, replace the goods within a reasonable time but without causing significant inconvenience to the buyer;

    (b) bear any necessary costs incurred in doing so (including in particular the cost of any labour, materials or postage).
