Have you thought that the buyer might have one of these already, which is faulty.

Have you thought that the buyer might have planned to send the faulty item back to yourself?

I would let them file the paypal dispute and let it run its course.

Dont worry about feedback, it isnt the end of the world.

As a private seller, and assuming you had stated that you don't accept any returns, basically the buyer has no rights against you whatsoever, it is effectively sold as seen.
Sorry but that is complete nonsense.
I would be willing to bet also that the Op sold the item as NEW.
Just because it wasn't used to get rid of that girly hair (urgh), it was still unpacked and plugged in which makes it second hand.

100%, if the buyer goes back to PayPal, the OP would be made to refund.

Also, if a dispute is opened and ebay refund the buyer through paypal, can the take the money out of my account or do they take me to court and the dispute is then between me and ebay?
They take the money straight out of your PayPal account.
It doesn't matter even if there is no money in it, as they will put you into a negative balance, and send DCA after you.

Did the buyer say the item was faulty (ie: wouldn't switch on) or faulty inasmuch as it didn't remove her hair? If the latter then it's tough. Those laser hair removal systems don't work for everyone.

In saying that, I would still refund her because if she paid using PayPal, they will find in her favour anyway.

  • The hair remover was advertised as 'Never Used' - yes it was unpacked and charged, but that was it. It was certainly not used to for its purpose of 'removing all that girly hair (ugh)'! and I realise that makes it second hand - as does the fact that it was 2 years old (even if unpacked)

My arguement is, that the buyer has had it for over a month before complaining and I have considered what she might playing it, but hadn't thought she might have a faulty one ready to send back to me. I'm not concerned about feedback, but I am concerned about refunding for the item that i was happy was in working order - at least charging up which is what she is saying it isn't doing.
  • Pimento, the buyer is saying it switches on but won't charge up.
