Esporta Health & Fitness

Let me begin by explaining the situation at hand. On 30th June 2010, I went to Esporta for the day to trial it with my partner.

I signed a 'special offer which runs out today' whereby rather than pay £160 signing up fee, it'll be free AND I get a month's free membership. I was informed I could CALL-IN and cancel if I wished to, so after all my queries were answered, I signed (like a fool) on the dotted line. Now, the next day I tried to cancel since I was informed I had 48 hours to do so. No-one picked up. I tried again the next day, which is around 48 hours, and I was informed I had to physically walk-in as per the terms and conditions, which totally contradicts what I was informed. I would NEVER have taken the contract out if she HADN'T have told me I could call-in. Suprisingly, today my friend received a text saying the SPECIAL OFFER that I was told was the LAST DAY for, was on until end of July.

I've tried e-mailing the general manager of the club and he has declined the membership cancellation which he deems to be 'fair'.

Can I take this matter up with Watchdog or even go to a small claims court? I was misinformed prior to signing and this is unfair I am now left with a £700+ contract that I don't need and didn't want (when I have the same services for half-price on an existing contract).

Anyone with help on this matter would be appreciated.

Sincerely,
Derek.

I would take 'call in' to mean I had to actually physically go there.

Not sure why you signed at all if you didn't actually want the membership. <shrugs>

Gyms are a bit of a rip off unless you have the time to go a lot.

If it is £700 for BOTH of you then that isn't a bad deal though.

Most like you to be there to fill in a cancellation form with a person then they can ask you stuff.

    What location is this club?

If I were you I'd be going in to see the general manager ASAP and sort it out face-to-face. Check what you've signed as you may have committed yourself to a full contract.

  • It's amazing how many people complain about Esporta's gym. They are the most dishonest business I have ever come across. They tell you straight lies to get you to sign up and then do not respond to your phone calls. Something has to be done about this as I have never known a business to tell you straight lies, you should record all calls and get everything you need in writing.
  • Has anyone got esporta's head office number? Or area manager for Croydon, I need it ASAP as I can't get through to my club membership.

As I have stated before I am a member of an Esporta club and have no complaints with them at all. I think the problem is that people sign agreements without reading what they are signing.
