If what you say is true, that the CSA keep loosing your letter I would suggest two things:

    1) Write another letter and send it recorded delivery so that it must be signed for.

    2) Phone them and tell them of the change of circumstance, that way the phone call will be recorded.

If after doing these two things there is no action by the CSA then I would recommend writing in with a complaint, again by recorded delivery stating they maladministration is prevelent withing the agencys handling of your case and explaining the reasons why.
When dealing with the CSA its important to note that it is commonly accepted as unfit for purpose, and by default this also means the staff are unfit for purpose.

If they have dropped out of college, PWC must inform CSA, this is the problem. How likely are some PWC to do this? (Not the majority I know - and as a PWC and NRPP, I immediately informed CSA and child benefit office when my ds left his course).

The CSA may say that as long as child benefit is payable then CS is liable, so if child benefit not informed then child benefit is likely to be paid until at least September when it will be reviewed.

You could try sending evidence to CSA that the child is no longer in studies, but in our experience they didn't seem interested at all, just kept tellng us as PWC getting child benefit CS still liable - irrespectiv of whether PWC is committing fraud or not (in our case she is)

Why not hand them notice that you are no longer going to contribute as you beleive the child no longer qualifies, won't the csa have to look into the case more so?

Is it's EMA then she won't be getting that if she isn't attending.
  • Hey,

The CSA will remain in force if Child Benefit is in payment, the problem is the rules have changed. It's not that the CSA is not interested when you tell them that the child is no longer in Full Time Education, it's just that now, they qualify as a child for CS purposes until child benefit stops OR they reach their 19th birthday whichever comes first, as the CSA has to recognise that in some circumstances a child should still be considered a child <19even if they're not in FTE.

If you believe PWC is committing Fraud, then you have to inform benefit fraud, and when they get raound to sorting it, CSA will be able to backdate any case closures.

This is happening to us also, child is 19 in Nov and has left college and is working full time.CSA refused to reveiw until September. We have contacted ICE and csa have now allocated us a case worker to review the case.We have also contacted child benefit to inform them the child left college 3 months ago.

If you are ignorant to the meaning of the abbreviation ICE, you may wish to look at this thread!
