Section 21 Help

Hi,

Quick question - if a S21 is served am I correct in thinking that this is all the notice that is needed and as a tenant I don't have to give one months notice as well?

    Correct. It is polite to give some notice, not least because you will want a check out inspection when you leave.

    Thanks, we've got our 2 months so have worked towards leaving when our tenancy comes to an end. The agent now says (probably because they haven't re-let) that we have only given them 10 days notice seemingly forgetting that they have served a S21.

    No qualifications, training or expertise needed to set up in business as an LA therefore no T should simply accept what they say as being correct.

    If you are still within a Fixed Term you could just leave at the expiry of that Fixed Term haven given them no notice. That's so even if they hadn't served you with a s21 Notice of Intent to Repossess.

    Perhaps the LA thinks his own s21 is invalid? Has he scheme- registered your tenancy deposit?

    I'm not sure - we haven't been advised where it is being held and I have asked twice now (once last year and once yesterday) as to where it is held as I have read that it's best to give them a few warnings as the law is a little bit grey due to it being poorly written.

    Ask them in writing! Not email, phone, text: Write! Much easier to get it sorted now before you actually get to the point of asking for your deposit back.

    Further to my earlier enquiries dated xxx and yyyy, and in accordance with the Housing act 2004, please confirm which scheme my deposit is lodged with.
