Estate agent issues

Hi just after a few opinions really:
Nearly 8 weeks ago i put a offer on a house which was accepted, however after 5 weeks my solicitor had recieved nothing from the vendors solicitor, after visiting the agent i was told that the house was in joint names but they had seperated over 20 years ago and could not contact her.
It has now been nearly 8 weeks and i have now withdrawn the offer as it does not appear that they can locate her, i have paid out for a mortgage survey and solicitor so am out of pocket, the agent failed to inform me of this situation when i put in the offer saying only 'that the vendor needs his ex wife to sign the papers' and only found out the extent of the issue after the survey had been carried out, from the agent
Unsuprisingly the agent is unwilling to reimburse me for the cost of the survey saying they haven't broken the law marketing the house with only one of the owners permission , however they are a member of the ombudsman and the code does state that they must have vendor/s permission to sell.
Clearly thay haven't done this, i am putting in a further complaint and considering escalating it to the ombudsman once a reply has been recieved, just after peoples thoughts and any advice really
