Estate agent still wants fees despite collapse of move

We were about to sign for a new house and the sale of our exisiting house, when our (already creaky) marriage finally collapsed... The estate agents claim that we still owe them the 1% of the agreed sale fee (reduced from 1.5% as a 'goodwill gesture') ie £2k, even though the buyers did not sign the contract on the sale…

It's all down to the wording in your contract with the Agent. Under the Estate Agency act all agents must use exact prescribed wording for contracts. The ready, willing and able etc. is the catch all wording that is still used by some agents - beware and read the T&C's.

Another bone of contention with seller is the sole agency agreement tie in periods - At Mr Green ours is 'zero' - we are trying to break the mold.
