Home learning collage problem

Hi I took out a course with them at the end of january this year a Comptia stratia and A+ at a cost of around £2200, with the course I was supposed to receive a tool kit as part of it along with my course materials. The materials arrived but the tool kit did not although I got a phone call after a week saying that it would be delayed due to high demand I accepted this and waited.

After another two months of waiting it still did not arrived so I emailed them to enquire what had happened to it to which I received emails back advertising other courses but no mention of it.

Then about another three weeks later some guy rang me up while I was busy at work to tell me that they couldn't provide me with it and they would knock £15 of my final payment instead. The whole incident with this put right of the course that with the fact the materials provided is so basic it doesn't teach you anything and the personal tutor I was promised seem's just to be an automated robot which grades you based on your score from a 3-6 mutiple choice question that classes as your assignment, which is not what the pushy sales man made it sound like.

With all this I decided to cancel my direct debit then forgot to get in touch with them due to my 6 month son having to go in hospital and losing my job by being made redundant, so I got a letter telling me that I hd defaulted so I rang them and explained all this to a women at the other end who told I had boken contract with them.

surely it is the other way round as I had not received the tool kit promised as part of the price but when I mentioned this to her she asked for proof I emailed them which I don't have and that I had agreed to it based on the man ringing me and telling me they were knocking £15 of my course fee. Is this right? they are now ringing my house daily .

    Right so the fact you never received a (what they value to be) £15 toolkit put you off the whole £2200 course?

    If you didnt feel that their service was as described or satisfactory, you should have made a complaint detailing this and if you wished to cancel, you should have told them this AND kept any confirmation you received in response from them (and if you didnt receive a response.....contact them to ensure they received your cancellation notice).

    And although the specifics of it being a free gift or actually part of the offer would help determine whether it could possibly be classed as a breach of contract, a breach will NOT automatically void the contract. I'm pretty sure it would have to be a fundamental breach in order for it to void the contract and imo, if i felt that they were in breach of contract, i would have written to them informing them of this - while keeping a copy for my own records and sending it recorded delivery.

    It may seem like a lot of hassle at the time, but if something goes wrong, you'd be awful glad you bothered.
