Software license agreement

Hi all,
Where would you stand if you brought some PC software from a shop, broke the seal to install it, but then disagreed with the license agreement. The shop wouldn't take it back as the seal had been broken, or would they have to? its not happened, was just wondering, after all, who has time to read those. lol

AFAIR, there was a test case on this where it was concluded that without opening the package, you could not view the agreement so the fact you opened the package was irrelevent and it basically came down to whether you installed the software or not. In the case of Windows, it was taken one further because you were only presented with the EULA during installation.
