    But the thing is it's money and time upfront for the Court costs and evidence collection to effectively 'make a bet' on winning the case, so it's not quite so easy!

    Any case law to back the OP's case?

    I would say if you try to persue this then the bench may 'accidently' get damaged and as it was a one off they then do the right thing and refund your money.

    No need. The Sale of Goods Act covers all of this quite adequately.

    Op might want to look at sections 17, 18 and 20.

    If they ever come back, that is.
