8 Month Old Laptop Broke - Apparently My Warranty Is No Good!

I bought my laptop 8 months ago and last week the laptop was left in a separate room for an hour, into which no person or animal entered and when I returned to use the computer I found that I had a large crack appear on my screen from the bottom corner to just past the integrated webcam. It could NOT have been due to ‘abuse, misuse or accidental damage’ which is the only exclusion mentioned in my warranty But they havent come out and accused me of any of those things!
First of all they told me that the warranty had expired when i asked why they said it was made on 1ST JANUARY 1900! And i had to send proof of purchase to prove it wasnt 110 years old! how pathetic is that obviously someone that thinks computers have always existed!
The retailers guarentee said its covered for a year, but said i need to go to the manufacturer to get it fixed, when i asked what about their guarentee i was told i need to send it to the manufacturers who will write a report about it! As far as I can tell they have just opened the lid and gone it needs a screen replaced it MUST have been one of those 3.
It hasn’t been dropped or suffered from any kind of impact damage EVER as the crack wouldn’t be from a corner it would be off of the edges and smashed in a ‘spider web’ formation.
I think its an overheating issue but both retailer and manufacturer are dismissing it saying that I dont know anything about computers! Despite the fact I know it has overheating issues as its constantly turning off and used to BURN my lap so i could only use it on the table - DEFIES THE OBJECT!
A google search has revealed several forum threads where other users have had the same issues on laptops made under the ACER group.

Shows that the crack on my laptop looks to be the same length and same position as the MULTIPLE people in this thread showing that again the IDENTICAL crack occurred under very similar circumstances.
They have sent me a bill for 133.44 to have it fixed or charge me 52.00 to have it returned unfixed!

After 6 months the burden of proof is with the consumer to show that the fault is due to an inherent manufacturing issue. Its up to you to prove on the balance of probabilities that the fault isn't due to misuse or wear & tear. You will need to get an engineers report to back your claim I'm afraid.0

would those links that show many people having the exact same crack on their laptops not suffice? because if we all abused our laptops then surely we would have very different style breakages not all IDENTICAL0

I wouldn;t think that would be sufficient proof as all of them could be due to abuse (dropping the laptop could cause a crack in the same place if there is a weak spot).
You would be best off getting a independent report completed and present it to the retailer.0 -

But it would be a weak point that can only come to light by being misused/dropped etc. If it is handled correctly it would not be an issue.
If you are adament that it is a inherent fault, get a report done and if they confirm it, the retailer will have to offer a remedy and a refund of the report cost (if they don't you can take the matter through the small claims court).0 -
