  • sorry that is not an allegation, it has to be specific (legal advice) i.e. You failed to turn on the radio when requested

    Issued original disciplinary letter at 16:00 one day and expected to appear at 10:00 the next. nothing at all mentioned on this matter beforehand.

    After writing to boss informing him of not enough notification of hearing told "if you need time to prepare then take the rest of today and tomorrow off" . 2 days later get letter informing me I've been suspended.
    One letter of complaint 50 people on coach no real "investigation".

    Don't know where you got your legal advice from - it's not very good. Was it the same place that told you to walk out? You haven't answered any of the questions we asked - and we are trying to help you, not discipline you. If you simply want somewhere to vent about how unfair it all is, please, carry on. But if you want some real legal advice - please answer the questions.

    If you have consulted a solicitor, why are you unsure of your basic rights in this situation?

    OP start from the beginning, write a nice long post and then people like SarEL will be able to give you good advice (and then you should check any advice given on a message board!)
    The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!

    If I give you advice it is only a view and always always take professional advice before acting!!!

  • Been to a disciplinary today, took written statement in answer to so-called allegations. Chair wanted to ask questions but i told them they had my response and walked out.
    Chair said as I was leaving " let me advise you of my (her ) rights".

    Could someone explain them

    Apologies, I misread. But the question still remains, if you have consulted with a solicitor, why are you then needing to ask the question here? The CoP covers also covers this.

    Yes, quite. And I don't know why I am explaining this again - except for a lunatic tendency. The ACAS code of practice is not LAW - it is guidance. And whilst it generally applies it doesn't apply the same in all cases. A solicitor? Cute! I am a QC (practicing) specialiising in employment law and especailly unfair dismissal; a senior partner in a law firm that only do employment law. And so far you are talking rubbish. In law. And i really don't care except for the fact that me and some other people here are trying to help you.

    So wise up here. We want the whole story from beginning to end - not edited highlights as ou see fit to tell us. Because otherwise we can't help. No skin off out noses - we aren't facing a disciplinary or the sack. So if you don't wnat to play - fine. And if you don't have 12 months employment already - which you have avoided answering - then it doesn't matter because it's pretty easy to sack you.

    Last attempt at helping you - get in the programme or I can find better things to do with my time.
