Third Party on the Mortgage

Hi,

My wife and I have been trying a trial separation (3 months), which has now become more of a permanent fixture.

Since moving out I have been stopping with my parents and I have been paying the mortgage, my wife wishes me to continue paying it on a permanent basis, instead of paying CSA for our 2 children (the mortgage being far more than the CSA, and would love to be able to pay both for the sake of the children).

I am not financially able to do this, as I am going to have to get my own property, whether it’s renting or buying, due to me not being able to stop with my parents forever.

I have suggested selling the property which she has point blank refused as she receives a large amount of benefits for our two children + her other 2 children from a previous relationship and is leading a good life with all the benefits she receives, where as I am struggling.

When purchasing the property I was unable to get a mortgage for the property we wanted due to my earnings (as my wife doesn’t work) and my father agreed to get the mortgage with us.

My wife has stated that under no circumstances will she pay the mortgage regardless and with my father now retired it is left to me.

With my father being a 3rd party on the mortgage and putting up the 15k deposit, would my father and I be able to force the sale of the property? (as a last resort)

I look forward to some advice.

    Bear in mind if you mess up then she might stop you seeing the kids... so weigh that up at all times...


    You could stop paying the mortgage and it'll end up being repossessed.

    If you get a divorce the judge will want to know your financial settlement.


    Ask her to consider marriage guidance counselling first. :)
