I dont know if anyone can help me or if this is the right place.
In November 09 I purchase 2 Ipod Touch (3rd generation) ipods, 8GB for my children.
Recently the ipods have had an update, which means if you have the 3rd generation ipod, you can open multiple internet windows.
You cant do this on the 2nd Generation ipod.
When my DS tried to download and use the software, he found he couldn't use it because the ipod he had was a 2nd generation one.
We contact amazon who sent out a replacement, only to find they had sent 2nd generation ones again.
They cannot provide 3rd generation ipods, only 2nd generation. They said they are prepared to refund the money to my account. The only problem with that, is we ordered 3rd generation and it would cost us now about £100 extra for each ipod as the 8GB ipodon the apple store site does not exist anymore, they only have 3rd generation ipods as 32GB size.
I thought I should be entitled to a 3rd generation ipod, and if they cannot get me one, should give me the difference it would cost for me to get one (wether its 8GB, or 32GB which is the only one now available.) This would be approx £200 for the 32GB 3rd generation ipod.
Does anyone know what my consumer rights are?
I have a confirmation email saying they are 3rd generation, and on my amazon account info it says they should be 3rd generation.
Any advise would be greatly appreciated.

Basically it seems that "There is no such thing as an 8GB 3rd gen iPod touch." The thread explains the confusion. Sounds like creative advertising to me.0 -
I can't offer any advice about 2nd/3rd generation Ipod touches, but can I add that the multi-tasking update in OS 4 has only been applied to Iphones and not Ipod touches.Striving to clear the mortgage before it finishes in Dec 2028 - amount currently owed - £26,322.670

Just to update you.
We have kept the original ipod touches and have been given £20 gift voucher for amazon (£10 per ipod) as compensation. This was the most they would give, even though I did try for more!
