I started on the 2nd yr of a 3yr F/T BSc (1st year exempt and course is over 21hrs/wk taught) in Oct 09.
Didn't understand your 2nd para point. Can I resubmit letter to be covered from when I started the course?0 -
Once you are disregarded then you cease being liable for any council tax due for the duration and your wife will become the person liable for any council tax due albeit with a 25% discount.If you are a F/T student for Council Tax purposes then you Council Tax account should show your wife as the person liable for any Council Tax due with a 25% discount.
If you can provide sufficent proof of your student status then there shouldn't be a problem backdating to Oct 09, Ive dealt with cases recently where the details have been backdated over 4-5 yrs with issue.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -
I have had the CT situation resolved now so thanks to all who provided advice.
I would like to ask if child tax credit is taken into account when assessing weekly income.
This is because I received a letter from HMRC at the beginning of July asking me to confirm income details for my tax credit assessment. Whilst on the phone to them I confirmed all the details they required to complete my assessment for the coming year, meaning I would not have to send back the hardcopy of the form.
Or so I thought until last week when no payment arrived. I called and was advised I hadn't completed my assessment (although they had a record of my call on the 2nd July) and my claim had ceased.
She said she could reactivate it and would set up again in time for this weeks payment.
We did get a payment this week of £6 more than we were getting, but we expected two payments (one missed and one for this week) So I called to clarify and was told that the missed payment has been added to my allowance for the year and then redistributed over the year, hence the extra £6 a week.
This now means we have approx £25 every 4 wks more income - £325 over the year. Does this mean our HB/CT will be reduced?

Can't help you with any of your questions but I've had a nightmare with both my Housing Benefit and Council Tax Benefit. After a friend of mine appeared in court on my behalf, due to me not being well enough to attend myself, Harringey Council realised they'd made a !!!!-up three years in a row and a Liability Order was not issued on 3 seperate occasions. However, this doesn't stop the thieving bar stewards from adding the costs of these non-existant Liability Orders to my Council Tax bills. The court system regarding Council Tax is a joke, if you lose - you lose. If you win - you lose. Even if you win a case in court over Council Tax, the sneaky gits will still try and chance their arms with an invalid Liability Order...at least Harringey Council do so anyway.
I've also had problems with my Housing Benefit. My letting agents put my rent up from £455 per calendar month to £520 per calendar month on 9th October 2009. It's supposed to take 6-8 weeks for them to process the rent increase...and almost 11 months later I'm still waiting. On 14th of this month my friend who has been helping deal with my Council Tax problems had a meeting with the Housing Benefit top-level management - only thanks to a solicitors letter. They said it'd finally be sorted in a week. I get a letter on 21st expecting it to have been sorted out and have it backdated 11 months...and they tell me they've cancelled my Housing Benefit claim altogether!!! My same friend had another meeting with them yesterday and now they've told him they'd made a !!!!-up at their end and that it'll FINALLY get sorted in 2-3 days time. I'll believe it when I see it lol.
My letting agents have now also told me that they're incresing my rent again from £520 per calendar month to £750 per calendar month despite Harringey Council not processing the last rent increase.
This country really is a joke and is in a complete mess. As soon as I'm well enough to start working again I'm leaving this country.0 -
Short answer is yes, if your wTC or CTC increase, your HB and CTB will reduceI currently manage a Housing Benefit service and have been working in Housing / council tax benefit (as was) since 2001.

You are lucky you didn't get a summons sooner. I got one 7 days after my payment was due. Go in there and sort it out, explain everything to them and see what they say, its all you can do really!0
