Buying a mobile on ebay - any rights

Hi all
I bought a new phone on ebay from a non business seller. It is now faulty. Does anyone know if I have any rights to getting it mended by the manufacturer?

    If it's been less than 45 days since you paid, and you paid with PayPal, and you can honestly say it is a fault of the phone and not you breaking it yourself, you can make a claim through PayPal if the seller doesn't co operate.

    Is the manufacturers warranty still valid?
    if not , then as it's a private seller there are very few rights..
