Some advice RE child DLA

Hi there everyone.
My 4 year old son was diagnosed with Bilateral Perthes Disease back at the beggining of april. We were told to put in a claim for DLA. He was put into a wheelchair and told to be kept completely non weight bearing and bed rest. He has quite a bad case im told and he has severe pain, especially during the night. He often isnt 'with it' when he is in pain and quite often urinates underneath himself when writhing with pain.
We were waiting on a letter back from the consultant and I was rang yesterday and asked a couple of questions. They asked me if im up during the night with my son which I am, about 45 minutes 2-3 times a night, how far he can walk? , well he isnt supposed to walk about at all. Consultant report said to mobilise as much as pain allows. well he can walk from one settee to another or into the kitchen but doesnt manage the stairs and so has a commode downstairs.

She told me we would have a decision by next week, my stomach is in knots since and its driving me mad.
Whats the likelyness he will get awarded anything ?
Whats the success rate of them awarding him ? or will we have to appeal ?

if no award is made then you should appeal,please get help to do this from welfare rights or cab
however from what you have said you may get HRC for him,mobility i`m not sure when it comes to children.

I'm assuming that the condition has been affecting him for more than three months - if thats right then I would say you have a pretty good chance of getting DLA for your son - but every decision is made on the facts of the case and by the decision maker assigned the case. It can be a matter of intrepretation.

A child under five cannot get the lower rate so would have to be bad enough to attract the higher rate. Though that sounds like a given in this case.

i dont want to get your hopes up i dont no nothing about your lads condtion but i had the same question asked to me as a adualt about night time needs i ended up with hrc and she told me over the phone after the question fingers crossed for you x

Thankyou for the advice everyone, I am going to be a wreck this week ive already been stressed today. I have been ok until this phone call but hopefully they will award him rather than having to appeal. What is the success rate of being awarded first time without having to appeal ?

think its very 50/50 and depends on what decion maker thinks

i have had it twice stright away one for 2 years this one for 5 but i knew they were both good forms but last one is in for appeal atm for higher mobilty , to me from what you have said it does look like he has care needs thou, i would ring on monday and ask if desion has been made hopefully it has and then uyou no whats going on x

Also, once its finally awarded, do I need to notify tax credits. Ive been told my tax credits will change, anyone any idea how it will affect things?
Do they pay carers allowance from when its applied for or from when DLA started ?

You'd get a disability premium on child tax credits if your child receives any level of DLA and a severe disability premium if he receives higher care.

or on the award of DLA middle or higher rate care component, back to when DLA was first claimed so long as a claim for Carers Allowance is made within 3 months of the award decision for DLA. This is important if a decision for DLA takes more than 3 months. Of course if the date of claim for DLA is within the past 3 months then Carers Allowance can't be backdated further than the date of claim of DLA.
