Tenants right to pick engery supplier and DPA issue !

My daughters just signing up for a new place, the gents told her the supplier is going to be Spark Energy. Spark aren't the current supplier, but the agent/landlord are going to change it to them any way !
She's googled and found very many 'issues' with this lot and told the agents she's no wish to go with them
They have told her that they have already send her info to them ! It dose say in the small print of the agreement that they will (which sounds very iffy). But she hasn't signed the agreement yet !
Isn't this in breach of the data protection act? Do they not have to have her permission to pass her info on to any third party, especially one with so many complaints as this lot ??

They can't make her change anything UNLESS it is clearly stated in her tenancy agreement that she has to allow them to change her supplier or force her to.

She hasn't signed the agreement.
The reason they give is that 'the landlords other 600 property's are with Spark' ! Well even the most basic research finds nothing good to say about them.
They have changed from whoever the current suppliers is to Spark, without asking anyone (it appears from reading that Spark give a kickback to the landlord). It seem that Spark then prevent any other supplier taking over by refusing to release the acc!
The agreement says this, but as I said she hasn't signed it. As I understand it, she has the right to pick under EU law. And, the bit that get me, even though she's hasn't signed anything, the agent has passed her bank info over to Spark !
Oh, and they now say that if she want to cancel they'll keep the £150 deposit !0 -
