estate agents up to old tricks!!!

hi,

we recently instructed estate agent to put our house on market, we were told that properties in area are selling within 6-8weeks. our house has been on the market for nearly 11weeks, we have had 1 viewing and no feedback/advice from estate agents.

we told them to remove the property from market and have had aload of abuse, they are threatening us with court if we dont pay their fees - we were told no sale no fee. they are also stating we are tied into them until october even though we stated 3months only!

    Have you checked the agreement you signed to make sure it says what they were telling you it said?

    Even if you sign a contract for 8 weeks, there's often a 2 week notice period to end it despite this fixed term. Check the Ts &Cs of the contract. How does the price of your property compare with similar properties in the area? Many estate agents give optimistic valuations just to secure the sales contract.

    As other posters have said ... check the small print. You could also complain to their professional association.

    The truth is estate agents are suffering as the housing market has resumed the down turn. People are not buying as prices are too high and they are expecting them to fall again. They are simply selling less properties and hard fiancial times hence we are seeing closures again.

    I can't see why they have reasons to sue. Many people change estate agents with out problems.

    I wouldn't worry it is probably the estate agents stress surfacing.

    In all areas, some houses are selling in 6-8 weeks, some are not. Yours didn't, have you revisited the price and compared it to others?

    Re the contract, have you read the small print? I bet it's all in there in black and white.

    11 weeks is nothing. It took me 12 months to sell at the peak of the market, when agents all said mine would be snapped up. The truth is, until it's out there, at a price, nobody knows.

    If it's not sold, it must be price or presentation. Do you have a Rightmove link so we can give you our "unbiased/stranger's eye opinion"? We can look at what else is for sale and let you know what we, complete strangers, would think on looking at your advert compared to others in your area.

    What does your contract say?

    As previously said, 11 weeks is nothing at present

    Do you actually want to sell? If so, why are you instructing the agent to take it off the market?

    I wouldnt be too worried about the length of the contract, you can always sit it out and wait for that to end, refusing all viewings from th EA.

    What did he say they would take you to court for? That is what you need to check in the contract. Some agents will have a withdrawal fee which you will need to pay. Find out if that is in your contract.

    When you asked them why viewing figures were so low and asked what might be done to improve them, what did the EA say that made you decide to take the property off the market altogether?

    You've been calling for the so-called "down turn" (sic) ever since the market started picking up in early 2009 brit.

    You hang on the words of Jonny Davis - a man who STR'd in 2002 and missed out on house price growth of 50 - 100% since then. Economics and house price predictions are not your strong point

    I suggest you go back to your fellow frothers on HPC, and leave the normal folks alone
