oh having a laugh!!

hi all,
oh and me are seperating after 12 years, now i have 3 children to him the youngest 1 only 13 months. I asked him how much he is giving me towards the house and kids and me, his reply was £300.00!!!!! he said hes not paying towards the mortgage because he wants to sell. (2 estate agents came out mine said sell for 130.000.00 when the little jobs are finished, his said 120.000.00 to sell for has it stands. Oh wont help me finish it so to get more money but did say that he would sign it all over to me.) But of course he knows that i cant afford the mortgage alone let alone anything else so im between rock and hard place. I would love to be able to stay in the home and be able to afford it just to rub his face in it but im really stuck.

How much should he be paying me for the kids? am i also right to think that he has to keep me aswell (been married for the last 3 years ) or have i got that wrong? He just told me that his mother is charging him 200.00 per month for board and lodgings how can she do that she only getting 100.00 less than his kids are!

Im so mad at moment i could scream in fact AAAAAAAAAAARRRRRRRRRRRRRRGGGGGGGGGGGGHHHHHHHHHHHHHHH, there i did!

Any help or ideas please really desperate heres soa to c if yous can help

    If you go via the CSA you will get 25% of his after tax wage.

    To get £300 a month via the CSA he would need to be earning approx £1200 a month after tax. Does he? If he does earn more than ask for more. If not then take the £300 a month as you will not get more.

    And no he does not have to pay to keep you. Spousal maintance is very rare now adays and as you work it is doubtful you will get anything.

    Re the tax credits: as soon as he leaves (the very same day) you need to call TCO to cease your joint application and ask for a new pack to apply in your own name. Any payments you receive which are based on your joint application after the date he leaves will have to be paid back. You shouldn't lose out because your new single award will be backdated to the day after he leaves.

    Note if he leaves, say on 10th September, and you get a weekly or monthly payment on 8th September you will not be entitled to all of that payment just the portion up to the 10th.

    I'm sorry I can't help with anything else but I'm sure there are others who have been through the same thing who will be along later.

    You can also get single person discount on your council tax of 25%, ring the council ASAP. Best wishes to you.

    Sorry to be devils advocate anything I say isnt meant to be offensive, just that I live on the other side of the coin.
    without thinking about the house
    OH contribution £300 + benefits £168 + £200 of your wages (it is a shared thing he isnt going to pay for them on his own.) = £668 which is more than enough for the kids per month.
    Also he would need money to pay for fuel and to see them etc
    You can also apply for single parent tax credits and get a higher rate and money to help with school uniforms and free school dinners (I think)

    Also you could probably cut your food bill down to £200 this would help you
    Any debts in joint names IIRC will have to be paid by both, anything that is in his name solely he will have to pay and visa versa.

    Now the other side - the house
    I think if you went to court you would keep the house AND if his name is on it jointly he would have to pay all of half of the mortgae till the kids have finished school.

    I would get a personal bank acoount asap If you havent already and contact all the relvant people for change of situation and bank details so YOU get your entitlement.

    I DO wish you the best of luck but please remember your OH will only contibute to keep the kids not you anyomore.

  • You would be better off financially on IS, Interest paid on mortgage, council tax paid, no child minding fees. They would make sure that he paid the right amount of maintenance. You would also get child tax credit and family allowance.

    You would only recieve the intrest on the mortgage after 9 months, and would only receive £10 of the maintenance, compared to all of it whilst working :confused:

    Tax Credits ignore maintanence payments as income.

    If you've got children then you should be getting CTC and WTC, if you think CTC has not been put on your award for some reason, you need to contact TCO and get it checked out.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
