How can I get my money back???

I owe a catalogue debt and this is being paid back via a company called NDR. In November last year I received a letter from them telling me my payments needed to increase. At the time I was paying weekly but decided that it would be easier paying 4 weekly. My bank is HSBC and via internet banking I am unable to change amounts or frequency so I decided to cancel my existing standing order and set up a new one.

I was unable to view the sort code and account number of where I should send the payments so I contacted NDR and they gave me the details. I then set up the required payment, paying the first instalment of the new arrangement by bill payment so it went immediately and then setting up a new standing order.

I received a letter from NDR during December advising me that no payments had been received on my account, I ignored this as I knew the bill payment had gone from my account and presumed the letter had crossed in the post. However when I received another letter in January telling me the same thing, I rang to find out what was going on. I was then informed by NDR that an error had occured, they had given me an incorrect sort code.

Obviously I sorted out a new payment to them immediately and rang my bank to request that they trace my payments. My bank initially told me that it was nothing to do with them and I needed to find out which bank the payment had gone to. I found out that the payment had gone to Natwest. They told me they couldn't do anything, a request had to come from my bank for the payment to be refunded.

I then went back into my branch of HSBC again and they promised to trace the payment. I have since tried to chase this with them and they keep saying they will come back to me once they have chased it but I am still yet to hear anything after 9 months!!

I hope someone can help me!!

Thanks Debbie

    Hi Debbie,

Frankly, this one is a bit tricky.

From what you have said, it seems that NDR are at fault here. I am assuming this is the debt recovery company.

Your bank has carried out your instructions to pay the standing order so they are not at fault. NatWest have also carried out your instruction so they are not at fault. The problem is that NatWest may be having trouble recovering your money (and it is still yours) from their customer if it has been withdrawn from the account into which it was paid.

You need to speak to NDR and agree to pay them the missing money as soon as NatWest returns it to you. Confirm this agreement in writing. Since it was NDR at fault, the letter should also hold them entirely responsible for the missing payments. Keep a copy of any letters you write.

If you have any difficulty, I suggest you go to a Citizens Advice Bureau, or similar, for advice. Take with you any documentation from NDR.

    Hope this helps.

    Hi guys
I am new, just joined few minutes ago. I wanted to start a new thread but i didn't know how. So this is not a reply. I had to start somewhere. Sorry for the disturbance. I have a question I wish to get an answer. I am not a British resident , do not live in UK but happened to have a SIPPS with a British provider. I want to opt out and cash my money . Is there a reason why not?
